If you are not of age and fraudulently claim to be, we will cancel your order and you may be subject to face legal consequences based on State and Federal law. We implement a verification system to certify that you are of age to purchase our products and engage in our platform.

The present terms allow you to access the website for personal use only. You may be required to provide information to access some segments of the website; This information should be accurate and will be presided over our Privacy Policy.

We reserve the right to limit or deny any user’s access to the Website at any time and take appropriate legal action in case the interaction causes a violation of the law.

We reserve the right to refuse or cancel orders for any reason, specially due to internal discretions or regulatory compliances. Our products are not intended for re-sale. If a product you desire is out of stock, you may engage in different mechanisms to fulfill your order when product becomes available.

Shipment logistics are handled by third party platforms that work with us to ship your orders as soon as possible. We don’t guarantee all orders will arrive on time or exclude possibilities of logistical mishaps, but our team is readily available at all times to assist with any issues encountered. We have a specialized department referred to in our operating platform that assists with returns of incomplete or inaccurate orders. We will charge and withhold applicable sales tax for orders where the law requires us to.

We disclaim all warranties of any kind. We will not be held liable for damages of any kind arising from any theory from the use or inability to engage in the Website. TERMS AND PRICING

Except where explicitly noted otherwise, prices displayed in our platform and for our products represent the full retail price listed on the product itself. We cannot confirm the full price of any item until you complete the online order form as this will resolve the issues of relevant taxes, shipping, and handling as and where applicable.

RANDOMLY AND NON-RANDOMLY SELECTED REWARD AND PRIZE NORMS

No matter the prize, reward, offer, or method of selection, there will always be a monetary transaction requirement when cigars are involved. Any and all winners must abide by our Randomly Selected Reward and Prize Rules as well as complete our Release and Declaration of Compliance in order to claim the reward or prize.

PRIVACY POLICY

We may store and collect some information derived from the user’s interaction in the Website, such as details of where the site was accessed from, the search engine’s history, order processing details, the items that the user clicked or engaged with, the amount of times the user accessed the site, and other similar actions with the purpose of improving the Website.

How to Make a Request :  You can make a request by emailing customerservice@mycigarpack.com. You will need to provide your first and last name, email address, home address zip code, request details, the type of request you want to make, and describe the nature of your relationship with us.

Company may provide web pages or other mechanisms allowing you to delete, correct, or update some of the Personal Information, and potentially certain other information about you (e.g., account information). For instance, you can make changes to your account information by updating or modifying your online account information via the “My Account” link provided at the top of each page. Company will make good faith efforts to make requested changes in Company’s then-active databases as soon as practicable, but it is not always possible to completely change, remove or delete all of your information or public postings from Company’s databases and residual and/or cached data may remain archived thereafter. Further, we reserve the right to retain data (a) as required by applicable law; and (b) for so long as reasonably necessary to fulfill the purposes for which the data is retained except to the extent prohibited by applicable law.

Responding to Requests: Your request will be evaluated to determine whether the requested change meets legal regulatory requirements and does not risk making our other data less secure or changing our other data. If we can’t honor any part of your request, we will tell you that in our response, as well as the reason(s) we cannot do so.

Absent a power of attorney, we will also require the Consumer to verify their own identity. We may verify identity based on matching information you provided with data we have maintained on you in our systems. This data could include, but is not limited to, email address, mailing address, or phone number.

1. Third Party Marketing and Your Additional California Privacy Rights

Separate from your “Do Not Sell” rights California residents have the following additional rights regarding disclosure of your personal information to third parties for their own direct marketing purposes:

We provide California residents with the option to opt-in to sharing of “personal information” as defined by California’s “Shine the Light” law with third parties, other than with our affiliates, for such third parties’ own direct marketing purposes. We do not share personal information with non-Affiliate third parties for their direct marketing purposes absent your consent. If you are a California resident, you may request information about our compliance with the Shine the Light law and/or withdraw previously given consent to sharing with non-Affiliate third parties for their direct marketing purposes by sending us an email to customerservice@mycigarpack.com  or by sending a letter to us at 10891 NW 17^th ST Unit 132, Miami, Florida 33171. Requests must include “California Marketing Privacy Rights Request” in the first line of the description and include your name, street address, city, state, and ZIP code.

Please note that we are only required to respond to one request per customer each year, and we are not required to respond to requests made by means other than through the provided e-mail address or mailing address.

AFFILIATE PROGRAM TERMS

As an approved affiliate, you agree to abide by the terms and conditions contained in this section and in the general terms of the website.

Your participation in the program is solely to spread the good word of your membership to receive a commission on referred memberships through your own website or personal referrals.

We reserve the right to approve, reject, or terminate any application in our sole discretion. Some reasons that may lead to termination include: inappropriate advertising, spamming, violation of intellectual property rights, and others.

The term of this Agreement begins upon your acceptance in the Program and will end when your Affiliate account is terminated. All liability, general indemnification and governing laws/jurisdiction terms of this website apply to this program.

Commissions will be enabled through credit provided for use in our sister company CIGAR YARD LLC and will not be processed through any type of payment. These will be generated as soon as possible – upon request. There is a one-commission limit per active account and will only be valid for successfully completed transactions.

These terms apply to MY CIGAR PACK LLC, CIGAR YARD LLC, and any other party with direct or indirect financial/corporate interest in the aforementioned.
